Constitutional Conservative: Biden’s “Moratorium” on Deportations Ruled to Violate Federal Immigration Laws
Analysis:
In the first weeks of his administration, Biden goes 0-1 on trying to violate immigration law. On the same day Joe Biden was inaugurated, he issued an executive order allowing most illegal immigrants to avoid prompt deportation. Though federal law – those pesky things passed by Congress – instruct the executive branch to deport those entering our nation illegally promptly, Biden illegally waved his magic pen to pause the majority of deportations so illegal immigrants could remain in the US. Biden did so in flagrant violation of federal law and within hours of taking office. After a Republican Attorney General sued Biden over the deportation moratorium, a federal judge blocked Biden’s illegal usurpation of Congress. Ultimately this was a win for the rule of law. Unfortunately, this stems from an attack on the democratic process and congressional power by another activist president.
Conclusion:
When any president seeks to usurp congressionally passed laws, we all must be concerned with the standing of the republic. When a president does so deliberately, and within hours of their inauguration, perhaps it’s time for us – the electorate – to question their motives. When a federal judge bars the President’s actions as illegal, the third branch of government affirms the conduct as unlawful. When a president acts illegally, repeatedly, particularly on the same subject matter, we might need to consider state action, impeachment, or both.
